Users agree to use the website for lawful purposes only. Prohibited use includes:

  • Attempts to breach security or systems
  • Misuse of content or copyrighted materials
  • Data extraction, scraping, or harvesting
  • Misrepresentation of affiliation with the Foundation

The Foundation reserves the right to restrict or revoke website access at its sole discretion.

3. Program Participation

5. Intellectual Property & Content Ownership

All website and program content is the exclusive property of The Walker Foundation, including but not limited to:

  • Curriculum, kits, and certificates
  • Characters and program structures
  • Videos, photos, and digital assets
  • Educational materials and copywriting
  • Event models and program names

Users may not, without written authorization:

  • Copy, reproduce, or distribute
  • Upload, archive, or reverse engineer
  • Convert, resell, or rebrand
  • Create derivative works
  • Create competing programs using Foundation content

Violations constitute enforceable intellectual property infringement.

6. No Recruitment / No Poaching

Users may not recruit, solicit, hire, divert, poach, or interfere with the Foundation’s relationships with:

  • Staff and volunteers
  • Donors and sponsors
  • Vendors and partners
  • Event locations, schools, churches
  • Government or community partners

Written approval is required.

7. Non-Compete / Non-Imitation Rules

Users and third parties shall not create or operate competing or parallel nonprofit or commercial programs that:

  • Use similar curriculum or program models
  • Target the same demographic groups
  • Imitate branding or structure
  • Cause public, donor, or partner confusion

This restriction applies for a period of ten (10) years unless written authorization is granted.

8. Anti-Defamation Clause

Users agree not to publish or distribute defamatory, false, misleading, malicious, or harmful statements regarding the Foundation, its leadership, programs, donors, or partners through any medium.

9. Third-Party Links & External Services

This website may contain links to third-party platforms. The Foundation is not responsible for external content, data practices, service availability, or performance. Users engage with third-party services at their own risk.

10. Media, Photography & Public Use

By attending Foundation events, participants consent to photography and recordings for educational, charitable, reporting, marketing, and documentation purposes.

Non-consent must be submitted in writing. Use of children’s images follows stricter standards and may require parental release forms.

11. Disclaimers

The Foundation provides services “as-is” without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, continuous programming, or end-user interpretation accuracy.

12. Limitation of Liability

To the fullest extent permitted by law, The Walker Foundation is not liable for damages, losses, data breaches, third-party misconduct, unauthorized use of materials, or participant behavior.

13. Indemnification

Users agree to indemnify and hold harmless The Foundation from claims arising from website misuse, Terms violations, program misconduct, unauthorized IP use, or defamatory or competitive actions.

14. Termination of Access

The Foundation may suspend or terminate access to the website or programs without notice for violations including misuse, harassment, intellectual property abuse, competitive interference, or harm to mission or reputation.

These Terms may be updated at any time. Updates become effective upon posting.

16. Governing Law & Venue

These Terms are governed by the laws of the State of Missouri, USA. All disputes shall be resolved exclusively in Missouri state or federal courts.
